What is the difference between Wait status 1 and 2?
The duration. Wait status 1 stays effective for one month and can optionally be extended for another month before this period expires. Wait status 2 stays active for the entire duration of the legal or arbitrational proceedings.

What is a Wait status and what is its purpose?
The Wait status prevents the transfer of a domain to another holder and can be requested in case of legal disputes. This guarantees that the holder remains the same for the duration of the dispute. Thus, the domain holder can not elude responsibility by transferring the domain to another person.

What can I do if someone has requested the Wait status for my domain?
Verify your own right to the domain. Feel free to contact the nic.at legal department for any questions. You are free to settle amicably with the applicant or to enter a lawsuit. A domain cancellation or a transfer to the applicant of the Wait status is possible at any time.

Who can request the Wait status?
Anyone. You just have to prove your legal claims regarding the domain, e.g. with copies from the commercial or trademark register.

How can the Wait status be requested for a domain?
Please inform the nic.at legal department by mail or fax about the domain as well as the claim you assert to it. Please include documents, like copies from the commercial or trademark register. If the claim is legally justified, Wait status 1 will take effect and the applicant as well as the domain holder will be informed in writing.

Does the domain remain operative during the Wait status?
Yes. The Wait status has no effect on the operation of the domain. The domain is not technically locked.

How long does the Wait status remain active?
Wait status 1 stays effective for one month and can optionally be extended for another month before this period expires. Wait status 2 stays active for the entire duration of the legal or arbitrational proceedings.

What happens if I don’t request a Wait status but go to court directly?
There is the risk that the domain holder transfers the domain to a third party during the lawsuit. Thus, the lawsuit would become obsolete, and you would have to sue the new holder (who can transfer the domain again....).

Can a Wait status domain be cancelled at any time?
Yes.

Can the holder of the Wait status domain perform data modifications?
Yes, any modifications except a change of the holder.

Is the party applying for Wait status privileged with regard to a new registration?
No. The domain will be registered according to the “first come, first served” principle.
